Actyve SRL is hereinafter referred to as “Actyve”, “we”, “our” or “us”.
By accessing our website (https://actyve.ai and its subdomains, hereinafter the “Site”), you agree to be legally bound by these Terms of Use (the “Terms”), as well as by our Privacy Policy.
2. Definitions
- You: any person accessing the Site, using it, or using our services.
- Services: all the services offered by Actyve, including in particular the set-up of customer acquisition infrastructures, advertising campaigns, AI sales agents, chatbots, marketing automations and CRM integrations.
3. Purpose of the Site
The Site is intended to present our services, to facilitate access to them, to provide general information relating to marketing and sales transformation, and to offer additional resources.
4. Conditions of access
Access to and use of this Site are reserved for persons aged at least 18. If you are a minor under the applicable law, you must obtain the consent of your legal representative.

We strive to ensure the accuracy of the information on this Site. However, it is provided for information purposes only and in no way constitutes professional advice. You must check its relevance before using it. Actyve guarantees neither the accuracy nor the completeness of the information published.

Actyve guarantees no result, revenue or commercial performance.
To the fullest extent permitted by law, Actyve accepts no liability for:
- loss of data, loss of profits or business interruption;

- any harm arising from the use of, or the inability to use, the Site or the Services.
14. Indemnification
You agree to indemnify and hold harmless Actyve, its directors, employees, partners and subcontractors from any liability in the event of a claim relating to your use of the Site or to a breach of these Terms.
15. Governing law and jurisdiction
These Terms are governed by Belgian law. Any dispute shall be submitted to the competent courts of Liège, Belgium.
In the event of a disagreement, the parties shall endeavour to resolve the dispute amicably before taking any legal action. Failing that, they may resort to arbitration in accordance with the CEPANI rules.

The Site is not affiliated with, sponsored or endorsed by Meta Platforms, Inc. (Facebook) or Google LLC.
All trademarks mentioned belong to their respective owners.
17. WhatsApp Business messaging
Where our Services include sending and receiving WhatsApp messages on behalf of a client, these messages are sent from that client’s WhatsApp Business account, operated through Meta’s official WhatsApp Business Platform, with its number and its business profile. The client remains the holder of that account and of that number.
The client using these Services undertakes to:
- comply with the WhatsApp terms and policies applicable to businesses, in particular the WhatsApp Business Terms of Service (whatsapp.com/legal/business-terms) and the WhatsApp Business Messaging Policy (business.whatsapp.com/policy);
- only have people contacted on WhatsApp who have agreed, before the first message, to be contacted through this channel (opt-in), and be able to prove that consent;
- stop all messages to a person who asks not to be contacted any more (STOP or any equivalent wording), and not reactivate a contact who has objected, unless that person takes a new voluntary step;
- comply with the regulations applicable to direct marketing, electronic communications and the protection of personal data.
Outside a 24-hour window following the last message received from a contact, WhatsApp only allows message templates approved in advance by Meta. Messages sent in that context follow these templates and Meta’s rules on commercial communication.
